Does anyone know if plywood falls under the exempt status as wood? I can not find anything on the CPSIA rules.

Hi Bethany, My company is not currently accredited (listed) by the CSPC - but for XRF testing accreditation is NOT required. We are primarily consultants working with clients who need the answers to questions exactly like those you are asking, and we have XRF screening capability. For the benefit of yourself and others with similar questions who may read this, here is some free consultation time; Acrylic yarn and polyester stuffing materials are NOT required to be tested for lead content. They are currently excluded from this requirement. Not sure what you mean by 'safety' eyes but if they are plastic, metal, buttons, wood or anything other than textile/fabric/thread they DO need to be screened for lead content. Felt and Fleece materials are also excluded from lead content testing. Technically, the textile material on the outside of a pipe cleaner doe NOT require testing but the metal wire inside DOES need to meet the lead content requirement. This does NOT mean that you have to have ALL the pipe cleaners tested - it means that your only need to have ONE XRF Screen done on a typical pipe cleaner - assuming you get all your pipe cleaners from the same source and they are all the same....... The same goes for eyes - if you are using something othr than fabric/thread for your eyes but you are using the SAME eyes for all your products - ONLY one XRF screening needs to be done on a representative sample - again assuming that you buy the same eyes from the same source all the time.

Bethany, I think the clarification excluded all the items you are use. Need to find the last thing that they CPSC stated about books and other items that would not need the testing - I'm pretty sure yarn was excluded since it obviously can't have lead in it. I think the biggest concern with testing is the toys - the ones that really could contain lead and phthalates. Of course having books published before 1985 is just as big a problem as prior to the ruling - because those books now have to be declassified as children's books or destroyed - think of all the Dr. Seuss books that have to disappear off the shelves or the other classics. But alas, I only remember vaguely reading that yarns were excluded and some other products as they have already been tested at the basic level. E :)

Fred are you one of the ones listed as being ok to use by the CPSIA? Becasue I've been reading that the testing has to be done by a CPSIA certified lab.

I'm interested in weather or not yarn (acrylic) needs to be tested as well as polysester stuffing and safety eyes. My other problem is if tested don't I have to have each skien of yarn tested for lead? If so the cost of testing far outweighs the cost of 3.00 skien of yarn, and 5.00 bag of stuffing. Cost for my actual produsct is about 5.00 a stuffed toy, and then with labour I charge 40.00 total. If I added in your testing fee, I'd have to charge over 75.00 per item (assuming I jsut test one of the 3 products: yarn, eyes, and stuffing). That's a lot of money for a 12 inch crocheted toy.
Add into that I like to use pipe cleaners, felt and fleece as well. That's not really something I think I can do if I have to test each bag of stuffing, each skein of yarn, and every batch of safety eyes.

I really hate to be mercenary in all this but we can do XRF screening for lead content @ $35 per sample with 3-5 biz day turnaround. I can also tell you exactly which items/materials you actually need to have checked based on the exclusions and will only screen what is absolutely necessary.

Well here we are in Day two and nothing has changed. I have been trying to find someone to do XRF Testing and the labs I can find that will do the testing are outrageous. I have a festival at Folly Beach coming up soon and I am stuck here in the middle with the CPSIA on toys. I am just so disgusted. I keep hoping Senator DeMint can get us some type of relief. Hallelujah!!!! I swear you sound just like I do. I will go read the Blog. I do not think we will ever recover completely from where the Obama Liberals (Pelosi and her bandits) are taking us.I guess if you have millions put away somewhere and have good tax people you will be just fine. I don't have either. I get fired up about all of this so much I get headaches from it. They really should follow Senator Demint, he really knows what is going to happen with the Trillion dollar handout and the CPSIA. It will never end......Jesse

Amen - I posted on my blog about what Publishers Weekly posted today. The chairs of the committee and subcommittee that overseas the CPSC wants Obama to ask Acting Chair Nancy Nord to resign - blaming the confusion and chaos on her when she is the only one who has admitted that this law is unreleastic and more damaging than beneficial. I think the chairs need to resign and get their heads out of their own butts long enough to see how this will literally kill the economy and there will be no chance of ever recovering. The new stimulus bill Obama has put forth will only damage the economy more. I would have loved DeMint's stimulus to have passed because he really sees the need to keep the money in the economy and where it should be kept. The next 10 years will be the roughest this nation will see. I hate that Obama is already crashing and burning - only two weeks in office.

For more on what I had to say - go to my blog. You'll get a kick out of my rant - and I don't care if Waxman comes and leaves a comment on my blog for what I said - lol.

I think every senator should follow DeMint's leadership and show support for CPSIA reformation and the stimulus act. But again, they haven't a clue - they think it looks good on paper but in reality it's not going to work - so much for trying - E :)

I can honestly say that I really like Senator Demint and proud to be from South Carolina. We really have someone who actually can read and understand what is going on. All those so call liberal experts on the CPSIA have no idea of what is in the law that they suppose to have written. When it is time for re-election they are going to brag about what they have done to protect children. What a joke....All they have to do is sit around and find ways not to pay their taxes and not get caught. 90% of those experts are all a bunch of hipocrits and loosers who only know how to lie and get away with everything untill they get caught...

With the majority of labs in China, You can not tell me that they will be in compliance. If the CPSIA really wants testing for all then the CPSC needs to esatablish their own labs for testing all children's items. I see a real bag of worms being developed in China. I bet the Chinese Govt. has alot to do with the test results and who ships children's items to the USA. The labs with the most kickbacks get the jobs. A question, Does HUD do their own testing for lead in older homes? I really do not know. I need to check that out. Less than three weeks now. Sure hope for the best and expect the worst.
