The Washingon Times will be printing an article in Monday's paper,
online now, blasting the CPSIA and how it is both killing businesses and hurting children. It cites the CPSC decision on brass bushings, quoting the Alliance for Children's Product Safety, "brass zippers, grommets and other apparel and footwear components, victims of this decision include brass instruments, musical bells and certain strin…

From The Alliance for Children's Product Safety
The Alliance for Children's Product Safety's "CPSIA Casualty of the Week" highlights how the Consumer Product Safety Improvement Act (CPSIA) is disrupting the U.S. marketplace in order to draw attention to the problems faced by small businesses, public institutions, consumers and others trying to comply with senseless and often contradictory provisions of the law. These provisions do nothing to improve product safety, but are driving…

The CPSC put out long awaited guidance on testing and certification. The hearings on this guidance took place on November 9. I wanted to give some preliminary comments:
General Comments:
The Guidance is generally helpful and clearly well-intended. This is a helpful change in tone that will be welcomed by the business…

Many of you read
my response to Chairman Tenenbaum’s article that was published in the Product Safety Letter. The Publisher wrote a

Today the
Wall Street Journal wrote a scathing review of the CPSIA and the CPSC's inability to deal with lack of flexibility provided to the Commission "Lead is a typical component of brass but poses minuscule risk to children through toys. As the CPSC's own staff remarked, "the estimated exposure to lead from children's contact with the die-cast toys would have little impact on the blood…

Nancy Nord released a
statement on Wednesday about the impact of the Commission's decision to deny Learning Curve's request for an exemption for brass brushings, which pose no safety hazard. She expresses concern about some of the broad ranging impacts this will have in the children's product's market, which will lead to the disappearance of many products which "do not present a real risk." She concludes "
I urge Congress to g…

Below you will find a press release from Commissioner Northup. She made the case in yesterday's video that the CPSC was given flexibility, and as a regulatory agency, should be using it. She lost.
CPSC, if you are going to cede your power to make common sense interpretations of this law, please pass the baton back to Congress by urging them to make much needed amendments to save the children's products industry. In the meantime, we likewise ask and urge you to extend the stay of enforcement for…

HTA endorsed a letter to Senator Pryor urging him and his to committee to
hold hearings regarding the CPSIA. Noticeably missing as a signatory of this document is the Toy Industry Association. No commentary needed...the missing endorsement speaks volumes as to their allegiances (ahem..Toy Safety Certification Program for the big boys...and the big boys themselves).…

The CPSC is inviting the public to participate in a hearing so the commission can gather opinions about a consumer product safety incident database. The hearing will begin at 9 a.m. on Tuesday, Nov. 10 in Bethesda, Md. We wish they (or Congress...or someone) would host a hearing on the hugely negative impact the law is having on American small businesses and the economy, while not making anyone safer. However a h…

Chair Tenenabaum
visits China. She states, "In a global economy, with goods coming from all over the world, it's important that we have clear standards that we can enforce on imports." We ask...could a law be any less clear? Can all the confusion possibly be having a positive impact on product safety? Never mind enforcement...how about those that are diligently trying to…

Here is an interesting commentary by Rick Woldenberg on the Learning Curve exemption request (denied). Whether or not you like Learning Curve, trains, brash brushings, etc., it is an interesting and instructive post about the insanity of this law...the CPSC readily admits the brushings pose no harm, yet they are not allowed under the law, and the CPSC won't budge.
