Spoke with someone at the CPSC - waste of time!

URGH!!! I've been leaving messages for several days now in an effort to speak with someone at the CPSC re: the CPSIA, specifically to ask if 2 products that I made (which are used by parents in the care of children, not by children themselves) are subject to the CPSIA. Today I kept calling the main operator until I annoyed her enough to connect me to a live person.

Very disappointing discussion.

The basic gist of her speal: "The CPSIA workers are too over-burdened at this time to handle the thousands of phone calls that we get every day asking questions like yours. I recommend you sign up for our email newsletters to receive updates. I also recommend that you seek legal counsel to ask about your particular products. We are also working hard to interpret the law. If the products are to be used by children under the age of 12, then the law applies." I also asked about small businesses and she said that at this time they are definitely not exempt.

WHAT?! Don't pass the stupid thing if you are clueless about it!!! And why should I pay a penny out of my pocket to interpret it? I'm furious!

The 2 products that I make are (1) nursing / breastfeeding cover-ups / aprons and (2) wet bags - they are waterproof bags that are used a lot by cloth diapering parents - great for putting dirty clothes, toiletries, etc in

The definition of a children's product is fairly clear. It has to be "designed or intended primarily for children 12 years of age or younger." I don't know what you mean by "used by parents in the care of their children." If the product is to be used by children, then it would be a children's product. If it not used by children, but only used by caregivers, then it probably isn't.

The problem is, the law was written and plopped into the CPSC lap. They cannot change/amend anything. Congress and the powers that be are the only ones that can do anything about it. yet, I believe they are too proud to admit they GOOFED and big time, and who wants to look like they are not for the safety of children? They don't want to be seen that way, so they make it appear it is all in the CPSC hands to amend . We need to be calling Waxman and Booby Rush!
